These Terms of Service ("Terms") govern your access to pocketlead.app and services provided by Pocket Lead ("Pocket Lead," "we," "us," or "our"). By visiting the website, submitting a form, purchasing services, or using our systems, you agree to these Terms. If you do not agree, do not use the website or services.
OUR SERVICES
Pocket Lead provides websites, lead-capture tools, CRM configuration, appointment scheduling, messaging automation, reputation-management tools, marketing support, and related services for small businesses. The features, deliverables, fees, and service period for a customer may also be described in an order form, proposal, invoice, or separate agreement. If a separate signed agreement conflicts with these Terms, that agreement controls for the conflict.
ELIGIBILITY AND ACCOUNTS
You must be at least 18 years old and authorized to act for the business you represent. You agree to provide accurate information, protect account credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account and for ensuring that your use complies with applicable laws.
CUSTOMER RESPONSIBILITIES
You are responsible for the accuracy and legality of content, contact lists, offers, instructions, and data you provide. You must obtain required permissions and consent before contacting customers or uploading personal information. You may not use our services for unlawful, fraudulent, deceptive, abusive, harassing, infringing, or spam-related activity, or attempt to disrupt, reverse engineer, or gain unauthorized access to any system.
MESSAGING AND COMMUNICATIONS
When you give Pocket Lead your phone number and consent, we may send service-related texts such as inquiry responses, appointment reminders, and follow-up. Marketing texts require separate consent. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Consent to receive marketing texts is not a condition of purchase.
Customers using messaging features are responsible for honoring opt-outs and following applicable telemarketing, texting, privacy, and industry rules. Pocket Lead may suspend messaging activity that appears noncompliant or harmful.
FEES, BILLING, AND CANCELLATION
Prices and payment terms are shown at checkout, on an invoice, in a proposal, or in a separate agreement. Unless otherwise stated, fees are due when billed and are nonrefundable once work or a subscription period begins. Recurring services continue until canceled under the applicable plan terms. Past-due amounts may result in suspension. Third-party usage charges, including phone, text, email, advertising, domain, or software charges, may be billed separately when disclosed.
THIRD-PARTY SERVICES
Our services may integrate with third-party platforms such as hosting

Those services are governed by their own terms and policies. We are not responsible for third-party outages, policy changes, account restrictions, data practices, or decisions.
RESULTS AND AVAILABILITY
Marketing and technology results vary. We do not guarantee a specific number of leads, appointments, reviews, sales, revenue, search ranking, or uninterrupted availability. You remain responsible for business decisions, lead response, customer service, pricing, fulfillment, and compliance.
INTELLECTUAL PROPERTY
Pocket Lead and its licensors retain rights in our software, systems, processes, templates, branding, and preexisting materials. Subject to full payment and any separate agreement, you may use customer-specific deliverables for your business. You grant us a limited license to use materials you provide solely to perform and support the services.
SUSPENSION AND TERMINATION
We may suspend or terminate access for nonpayment, legal or security risk, misuse, violation of these Terms, or conduct that may harm users, third parties, or our systems. Upon termination, outstanding fees remain due. Provisions that by their nature should survive termination will survive.
DISCLAIMERS AND LIMITATION OF LIABILITY
To the extent permitted by law, the website and services are provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, noninfringement, or guaranteed results. To the extent permitted by law, Pocket Lead will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, lost opportunities, or third-party platform actions. Pocket Lead's aggregate liability for a claim will not exceed the amount you paid Pocket Lead for the affected service during the three months before the event giving rise to the claim.
INDEMNIFICATION
You agree to defend and indemnify Pocket Lead from claims, losses, liabilities, and reasonable costs arising from your content, data, customer communications, violation of law, misuse of the services, or breach of these Terms.
GOVERNING LAW
These Terms are governed by the laws of the State of South Dakota, without regard to conflict-of-law rules. Any dispute must be brought in a court with jurisdiction in South Dakota unless a separate written agreement states otherwise.
CHANGES
We may update these Terms periodically. The effective date above indicates the latest revision. Continued use after updated Terms are posted constitutes acceptance of the revised Terms.
